Conditions of Sale
-
All lots are sold as shown, with all faults, imperfections and errors of
description. Every effort has been made to ensure the accuracy of the
description of each lot, but these, whether made orally or in the catalogue,
are expressions of opinion and are not representations of fact. No employee of
the Auctioneers has any authority to make any representation of fact and the
Auctioneers disclaim on behalf of the Vendor and themselves responsibility for
authenticity, age, origin and condition and for accuracy of measurement or
weight of any lot or lots. Items are sold as viewed by the buyer with all
faults, imperfections and errors of description. However, we do not imply there
are no other faults, and the buyers must satisfy themselves as to all faults,
cracks chips wear, imperfections, restorations, etc. Clocks and other
mechanical working devices are not warranted to run. It is assumed that all
gemstones have probably been subjected to a stable and possibly undetected
color and or clarity enhancement process. All measurements are of largest
dimensions unless otherwise specified. Personal inspection is highly
recommended.
-
The highest bidder acknowledged by the Auctioneer shall be the buyer. The
Auctioneer has the right to reject any bid and to advance the bidding at his
absolute discretion and, in the event of any dispute between bidders, to
determine the successful bidder or to reoffer and resell the article in
dispute. Should there be any dispute after the sale, the Bloomington Auction
Gallery record of final sale shall be conclusive. On the fall of the
Auctioneer's hammer, title to the offered lot shall pass to the buyer, who
shall forthwith assume full risk and responsibility for the lot and may be
required to sign a confirmation of purchase, supply his/her name or address and
pay the full purchase price or any part thereof. If the buyer fails to comply
with any such requirement, the lot may at the Auctioneer's discretion be put up
again and sold, and all deficiencies and charges to be charged to the original
buyer.
-
If there is a reserve price on any lot the auctioneer may bid on behalf of the
seller.
-
A Buyer's Premium of twelve & one half percent (12-1/2%) of the sale price
will be added to each purchase to reach the total sales price payable. 2-1/2%
discount for cash or checks. Buyers are required to pay sales tax on the total
sales price, including buyer's premium.
-
All purchases must be paid for by the conclusion of the sale unless special
arrangements have been made.
-
Purchases must be paid for in cash, certified checks or travellers checks. No
personal checks are accepted without established credit with our management.
-
All items must be paid for in full before they can be removed from the
premises.
-
All items must be removed within five (5) days after the sale. Thereafter,
Bloomington Auction Gallery reserves the right to place unclaimed articles in
storage at the buyer's responsibility and cost. Goods not collected after three
months will be sold, the money after expenses and commissions for sales to be
credited to buyer's account.
-
We reserve the right to retain possession of goods purchased until such time as
a new customer's credit has been cleared.
-
By the making of any bid the buyer acknowledges his acceptance of these terms
and conditions and notices and other conditions in the catalog.
-
Bloomington Auction Gallery acts solely as agents for the Seller.
-
Bloomington Auction Gallery is not liable or responsible for any accidents.
-
For those unable to attend the sale or who must leave before the finish of the
sale we would be pleased to arrange for their bids to be executed. Absentee
bidders agree that Bloomington Auction Gallery may act as Dual Agent for Buyers
and Sellers, accept absentee bids from buyers and execute them competitively
against other left bids, telephone bids and internet bids. All bids will be
subject to the terms and conditions set out in the catalog. We offer this
service in an effort to help our clients and will not be held responsible for
error or failure to make bids.
-
In order to assist handicapped patrons, a staff member is available at all
times to assist with bidding procedures.
